Caveat: Tennessee Torts

Plaintiff= s attorneys who represent clients with causes of action arising out of vehicular collisions in Tennessee need to be aware that Tennessee has a one year statute of limitations governing such actions. The Tennessee statute of limitations provides in part:

Tenn. Code Ann. ' 28-3-104 (2004)
28-3-104. Personal tort actions

(a) The following actions shall be commenced within one (1) year after the cause of action accrued:

(1) Actions for libel, for injuries to the person, false imprisonment, malicious prosecution, breach of marriage promise;

This statute of limitations is shorter than the corresponding Alabama two year statute provided in Ala. Code 1975, ' 6-2-38. Be aware of this shorter Tennessee period and do not allow your client= s cause of action to expire while negotiating with a tortfeasor's insurance company.
